The lawyers at KILLMER, LANE & NEWMAN, LLP have enjoyed tremendous success as trial attorneys during their legal careers. Mr. Lane has tried over one hundred cases to jury verdict and Mr. Killmer has tried an equally impressive number. Ms. Newman has assisted in a substantial amount of litigation.

A non-exhaustive list of cases is provided below as representative of the legal work performed by the attorneys of KILLMER, LANE & NEWMAN, LLP in the last several years. The cases represent results obtained by Mr. Killmer, Mr. Lane, and Ms. Newman working individually and in tandem with other attorneys as co-counsel.


Representative Trials and Verdicts

Tower Corp. v. Rabah Khatib
Darold Killmer represented an Arab-American hotel Manager (Executive Tower Inn, Denver) who had been wrongly terminated and retaliated against. Denver District Court jury awarded damages in favor of our client in the amount of $3,875,000 plus attorneys fees and costs of over $200,000. The parties entered into a confidential settlement after the trial.

Marvin Fester v. Farmer Brothers Coffee, Inc.
David Lane and Mari Newman represented Mr. Fester in an age discrimination lawsuit against major national coffee company, and secured a jury verdict in the amount of $330,397, plus award of attorneys fees and costs in excess of $225,000. The case was affirmed in its entirety by the Tenth Circuit Court of Appeals.

Pam McCroskey, M.D. v. Colorado Anesthesia Consultants, P.C.
In a sex discrimination retaliation case brought under federal law litigated by Darold Killmer, a federal jury awarded our client $1,700,000 in compensatory and punitive damages. Though this award was subject to a federal damage cap, the Court awarded an additional amount for attorneys fees and costs of over $200,000. The defendant paid the judgment without appeal.

Dave Minshall v. McGraw Hill-KMGH/Channel 7
In an age discrimination case tried by David Lane, a federal jury and judge awarded our client $562,152 for violations of the Age Discrimination in Employment Act. After attorneys fees and costs are added in, the total judgment approaches $800,000. The case was affirmed in its entirety by the Tenth Circuit Court of Appeals.

Scott Millard v. Jeppesen Sanderson Inc.
Darold Killmer won a whistleblower jury trial in Arapahoe County, with the total award exceeding $350,000. All amounts awarded by the jury and the judge were paid by the defendant without appeal.

Africa House & Tseghe Foote v. Tabor Center
Darold Killmer represented an African American shop owner and her African Imports and Arts store against the Tabor Center shopping center and its owners and management company. Our clients secured a jury verdict which totaled $2,850,000 plus attorney fees and costs of over $200,000. The primary judgment was reduced to about $1.5 million after the trial. After proceedings in the 10th Circuit Court of Appeals, the case is still being litigated in the federal system.


Representative Pre-Trial Settlements

Sweeney v. Town of Parker
Darold Killmer and David Lane settled a whistleblower-type case based upon retaliation against the exercise of First Amendment protected free speech on behalf of our client against his former municipal employer for $450,000.

Schaefer and Johnson v. City of Rocky Ford
Darold Killmer and Mari Newman settled a racial harassment and retaliation case on behalf of two municipal employees for an amount in excess of $450,000.

Weinberg v. Eagle County
Mr. Lane represented a wrongfully terminated air traffic controller on a whistleblower case in federal court and obtained a settlement of $200,000.

Jane Doe v. XYZ Investments, Inc.
(Confidential settlement) Darold Killmer and Mari Newman settled a wrongful discharge and fraud case on behalf of our client against an investment firm, the settlement amount exceeding $1,100,000.

James Mervin v. Furlong
Mr. Lane represented a prison inmate who was assaulted by another inmate and obtained a $70,000 settlement from the State of Colorado.

John Doe v. ABC Technical School
(Confidential settlement) Darold Killmer and Mari Newman settled a race discrimination and wrongful discharge case on behalf of our client against a Technical College in the amount of $185,000.

Whitfield v. Eagle County
Mr. Lane represented a class of plaintiffs who were victims of race-based drug courier profiling in the United States District Court for the District of Colorado and obtained a class-action settlement of $800,000.

Jane Doe v. ABC School District
(Confidential settlement) Darold Killmer settled a sex and age discrimination case on behalf of our client against a state school district in the amount of $435,000.

Jane Doe v. XYZ Healthcare
(Confidential settlement) Darold Killmer settled a sex discrimination and retaliation case on behalf of our client against a multinational healthcare company in the amount of $170,000.

Jane Doe v. XYZ Power Company
(Confidential settlement) David Lane represented a woman who was the victim of sexual harassment in the workplace and the case settled for $330,000.

John Doe v. XYZ Corp.
(Confidential settlement) Darold Killmer and Mari Newman settled a race discrimination and retaliation case on behalf of our client against a multinational documents services company in the amount of $250,000.

Jane Doe v. ABC Entertainment
(Confidential settlement) Darold Killmer and Mari Newman settled a sexual assault and discrimination case on behalf of our client against a male entertainment establishment in the amount of $375,000.

Fenton v. Pella Windows
David Lane represented an older worker who was the victim of age discrimination and obtained a jury verdict of over $200,000.

Jane Doe v. XYZ Motel
(Confidential settlement) Darold Killmer and Mari Newman settled a race discrimination in public accommodations case on behalf of our client against a national hotel chain in the amount of $175,000.

Jane Doe v. ABC Physicians, Inc.
(Confidential settlement) Darold Killmer settled a sexual assault and discrimination case on behalf of our client against a physicians medical group in the amount of $202,000.

Jane Doe v. A&Z Law Firm
(Confidential settlement) Darold Killmer settled a race and disability discrimination case on behalf of our client against a Denver law firm in the amount of $100,000.

John Doe, by and through his Next Friend, James Doe v. City of XYZ
(Confidential settlement) Darold Killmer settled an invasion of privacy and illegal wiretapping case on behalf of our client against a City and its police department in the amount of $150,000.

John Doe and James Doe v. ABC Automobile Dealership
(Confidential settlement) Darold Killmer settled a race discrimination case on behalf of our two clients against a major automobile dealership in the amount of $270,000 plus reinstatement into a management position for one client.

Jane Doe v. XYZ Corp
(Confidential settlement) Darold Killmer settled a breach of contract case on behalf of our client against a computer software firm in the amount of $200,000.

John Doe v. A&Z Manufacturing
(Confidential settlement) Darold Killmer settled a disability discrimination case on behalf of our client against a multinational appliance manufacturer in the amount of $150,000.

Jane Doe v. ABC Homebuilders
(Confidential settlement) Darold Killmer settled a sex discrimination case on behalf of our client against a major homebuilder in the amount of $85,000.

Jane Doe v. ABC School District
(Confidential settlement) Darold Killmer settled a free speech case on behalf of our client against a large school district in the Denver metropolitan area, for $75,000 and other significant consideration.

Jane Doe v. ABC Furniture Company
(Confidential settlement) Darold Killmer and Mari Newman settled a sex discrimination case on behalf of our client against a furniture retail company in the Denver metropolitan area, for $80,000.

John Doe v. XYZ Manufacturing
(Confidential settlement) Darold Killmer settled an age discrimination case on behalf of our client against an industrial manufacturing company for $75,000.

The Doe Family v. ABC Hotels, Inc.
(Confidential settlement) Darold Killmer and Mari Newman settled a race discrimination in public accommodations case on behalf of our clients against a national hotel chain in the amount of $165,000.


Representative Criminal Cases

United States v. David Wright
David Lane was retained to defend an individual charged by federal indictment with multiple white collar criminal offenses. Mr. Lane successfully secured the complete dismissal of the indictment and of all charges against our client.

California v. Jerry Frye
David Lane represented an inmate accused of capital murder in California in his appeal to the California Supreme Court.

Colorado v. Frank Rodriguez
David Lane represented an inmate accused of capital murder in Colorado in his federal habeas corpus proceedings in the United States District Court for the District of Colorado and in the Tenth Circuit Court of Appeals.

Colorado v. Dante Owens
David Lane represented Dante Owens at the trial level in his death penalty prosecution before the Arapahoe County District Court in Colorado.

United States v. Marek Kowaalski
David Lane represented Marek Kowaalski in his federal death penalty case in the Middle District of Pennsylvania.

Texas v. Baby Ray Bennett
Darold Killmer represented Baby Ray Bennett in his death penalty trial in deep east Texas, securing a jury verdict of life and the rejection of the prosecution's efforts to impose the death penalty upon Mr. Bennett.

United States v. Tony Davi
David Lane represented Tony Davi in his federal death penalty case in the United States District Court for the District of Nevada.

United States v. Uriel Bustamante
Mr. Lane represented Mr. Bustamante in his federal death penalty case before the United States District Court for the District of New Mexico.

City of Denver v. 140 Columbus Day Protestors
Mr. Lane represented 140, mostly Native American protestors arrested during a Columbus Day march in Denver.


Mr. Lane has represented thousands of criminally accused defendants facing all conceivable charges ranging from complex securities frauds in the United States District Courts, to relatively simple drug charges in numerous state courts.

Mari Newman has also represented numerous criminally accused defendants charged with alcohol related driving offences and misdemeanor charges of various types.
